Third Amendment To Law No. 66/VIII/2014, Of 17 July

(Legal Regime for Entry, Stay, Exit and Expulsion of Foreigners from Cape Verdean Territory)

On the 8th of May, Law n.º 27/X/2023 was published, which makes the third amendment to the Legal Regime for Entry, Permanence, Exit and Expulsion of Foreigners from Cape Verdean Territory, which will come into force 120 (one hundred and twenty days) after its publication.

In essence, this Law amended the Legal Regime for Entry, Stay, Exit and Expulsion of Foreigners, to incorporate the special treatment regime given to citizens of CPLP Member States, in general:

– Citizens of CPLP Member States who hold diplomatic, official, special and service passports are exempt from visas;

– Citizens of CPLP Member States who hold ordinary passports for short stays are exempt from visas;

– The request for entry for temporary stays by certain professional categories, citizens of the Member States of the CPLP, is subject to administrative authorization;

– It confers the right of residence in the national territory to citizens of the Member States of the CPLP, provided that the applicant is not subject to an entry banning measure and does not constitute a threat to order, security or national public health.

The amendment also provided for the possibility of a residence visa for the exercise of a professional activity performed remotely outside the national territory, by subordinate workers and independent professionals, to natural and/or legal persons with domicile or headquarters outside the national territory.

The amendment also waives proof of tax and social security status for citizens who have been granted or renewed a residence permit within the scope of extraordinary regularization processes (in the framework of an exceptional regime).
